Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Raksha mobile application or the website at raksha.club (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Raksha Club, a company based in Hyderabad, Telangana, India.

2. Description of Service

Raksha is a family phone safety and recovery application that allows consenting family members to:

• Locate and ring misplaced devices within a trusted family circle.
• Activate Lost Mode with GPS tracking and a recovery lock screen.
• Broadcast an SOS alert with live location to all family circle members.
• Monitor battery status and connection state of family devices.

All features operate only with the explicit consent of every participating member. Raksha is not a surveillance or covert monitoring tool.

3. Eligibility and Accounts

You must be at least 18 years old to create a Raksha account. Users between 13 and 17 may use the Service only as a family circle member added by a parent or legal guardian who holds the account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@raksha.club if you suspect unauthorized access.

4. Family Circle and Consent

A family circle is a group of trusted members you personally invite. Each invitation requires the recipient to actively accept before their device data is shared. You may add or remove members at any time from within the app.

By accepting an invitation, each member acknowledges that their device location and status will be visible to other circle members. Raksha does not permit adding devices to a circle without the device owner's knowledge and consent.

5. Prohibited Uses

You agree not to use the Service to:

• Monitor or track any person without their full, informed consent.
• Stalk, harass, intimidate, or harm any individual.
• Circumvent, disable, or interfere with security features of the Service.
• Reverse-engineer, decompile, or disassemble any part of the app.
• Use the Service for any unlawful purpose under applicable Indian law or the law of your jurisdiction.
• Attempt to gain unauthorized access to other users' accounts or data.

Violation of these restrictions may result in immediate account termination and, where applicable, referral to law enforcement.

6. Subscription Plans and Payments

Raksha offers a free tier and paid subscription plans (Family Plus and Family Max) as described on the Pricing page. Paid subscriptions are billed monthly or annually via Google Play In-App Billing. All payments are governed by Google Play's billing policies.

Annual plans include a 30% discount compared to the equivalent monthly rate. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. Refunds are handled per Google Play's refund policy.

7. Intellectual Property

All content, branding, design, software, and features of the Service are the exclusive property of Raksha Club and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the app solely for personal, non-commercial family safety purposes.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand how we collect and use your data.

9. Service Availability

We strive for high availability but do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may suspend the Service for maintenance, upgrades, or circumstances beyond our control. Emergency use cases (SOS, Lost Mode) should not rely solely on Raksha — always contact local emergency services (112 in India) for life-threatening situations.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will locate, recover, or protect your device in every situation. Location accuracy depends on device hardware, network availability, and GPS conditions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RAKSHA CLUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Raksha Club, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any third party's rights.

13. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

14. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via in-app notification at least 14 days before they take effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

15. Termination

You may terminate your account at any time from the app settings. We reserve the right to suspend or terminate your account for violation of these Terms, with or without notice, at our sole discretion.
